Unlimit Mobile — Terms and Conditions of Service

1.1 You must be at least 18 years old (or the age of majority in your state) and capable of forming a binding contract to open an account. 1.2 You agree to provide accurate, current, and complete information during registration and to keep it updated. You are responsible for all activity occurring under your account and for maintaining the confidentiality of your account credentials and PIN. 1.3 We reserve the right to refuse service, suspend, or terminate accounts at our discretion, including for suspected fraud, non-payment, or violation of these Terms.

2.1 Unlimit Mobile provides prepaid and/or postpaid wireless voice, text, and data services that operate on the Host Network. We do not own the underlying wireless network infrastructure; coverage, speed, and quality depend on the Host Network's availability and are subject to change without notice to us. 2.2 Coverage maps, if provided, are estimates only and not a guarantee of service availability at any specific location. 2.3 References to Unlimit Mobile operating on "the nation's fastest 5G network" describe the performance of the underlying Host Network as measured by independent testing sources (e.g. Speedtest / RootMetrics), and are based on network-level performance rather than a guarantee of individual speed. 2.4 Services may be affected by geography, terrain, weather, network congestion, maintenance, or Host Network outages, none of which are within our control.

3.1 Current plan pricing, data allotments, and features are listed at www.unlimitmobile.com and may change with notice as described in Section 13. 3.2 Prepaid Plans: Service is provided on a pay-in-advance basis. Your plan expires at the end of the applicable billing cycle unless renewed. Unused data, minutes, or texts do not carry over unless expressly stated and do not entitle you to a refund upon expiration. 3.3 Postpaid Plans (if applicable): You authorize us to charge your designated payment method on a recurring monthly basis. Late or failed payments may result in suspension of Services. 3.4 All fees are exclusive of applicable federal, state, and local taxes, and regulatory fees (including USF contributions, 911 fees, and telecom surcharges). 3.5 Autopay/auto-renewal, where enabled, may be cancelled at any time through your account settings prior to the next billing date. 3.6 Refunds are provided only where required by law or expressly stated in a plan's terms. Activation fees, SIM/eSIM kit fees, and used service periods are generally non-refundable.

4.1 Plans marketed as "unlimited" are subject to Unlimit Mobile's and the Host Network's fair use and network management policies. After a specified high-speed data threshold, data speeds may be reduced or deprioritized relative to other traffic, particularly in congested areas. 4.2 Certain uses — including tethering/mobile hotspot beyond plan allotments, commercial resale, machine-to-machine use on consumer plans, or use inconsistent with typical consumer usage patterns — are prohibited unless expressly permitted. 4.3 We reserve the right to manage network traffic reasonably and in accordance with FCC open internet rules.

5.1 Devices sold by Unlimit Mobile may be locked to the Host Network for a period as disclosed at the time of sale, consistent with applicable FCC device unlocking rules. Unlocking requests will be honored once eligibility conditions are met. 5.2 You are responsible for ensuring any device you bring to Unlimit Mobile ("Bring Your Own Device") is compatible with technical requirements. 5.3 Lost, stolen, or damaged SIM cards/eSIMs may be replaced for a fee.

6.1 You may port an existing phone number to Unlimit Mobile, or port your number away to another carrier, subject to FCC number portability rules. We do not charge a fee to port a number away. 6.2 Porting delays or failures caused by incorrect account information or third-party carriers are outside our control.

7.1 Where technically available via the Host Network, 911 emergency calling may not function during network outages, in areas without coverage, or if your device lacks power. 7.2 If your service supports location-based 911 routing, location accuracy depends on device, network, and environmental factors. 7.3 It is your responsibility to have an alternative means of contacting emergency services if Unlimit Mobile Services are unavailable.

You agree not to use the Services to: (a) violate any law or regulation; (b) transmit unlawful, harassing, defamatory, or fraudulent content; (c) engage in robocalling, spam, or unsolicited telemarketing in violation of TCPA or CAN-SPAM; (d) interfere with the Host Network; (e) engage in SIM-swapping fraud or unauthorized account access; or (f) resell Services without written authorization.

9.1 Our collection, use, and disclosure of your personal information, including CPNI as defined under 47 U.S.C. § 222, is governed by our Privacy Policy at www.unlimitmobile.com/privacy-policy. 9.2 Residents of California, Virginia, Colorado, Connecticut, Utah, and other states with applicable privacy statutes (e.g., CCPA/CPRA) may have additional rights described in our Privacy Policy. 9.3 You consent to our use of CPNI to market other Unlimit Mobile products and services unless you opt out.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMIT MOBILE DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, UNLIMIT MOBILE AND ITS OFFICERS, EMPLOYEES, AND THE HOST NETWORK OPERATOR SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES. OUR TOTAL AGGREGATE LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR SERVICES IN THE THREE (3) MONTHS PRECEDING THE CLAIM.

12.1 Agreement to Arbitrate. Except for small claims court matters and disputes involving intellectual property, you and Unlimit Mobile agree that any dispute shall be resolved by binding arbitration administered by AAA / JAMS. 12.2 Class Action Waiver. YOU AND UNLIMIT MOBILE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER. 12.3 Opt-Out Right. You may opt out of this arbitration provision within 30 days by sending written notice to support@unlimitmobile.com. 12.4 This arbitration provision is governed by the Federal Arbitration Act.

We may modify these Terms, plan pricing, or features at any time. Material changes will be communicated via email, SMS, account notification, or website posting.

We may suspend or terminate your Services immediately for non-payment, fraud, abuse of the network, violation of these Terms, or as required by law.

These Terms are governed by federal law and the laws of the State of Delaware.

16.1 Entire Agreement. These Terms, together with our Privacy Policy, constitute the entire agreement. 16.2 Severability. If any provision is found unenforceable, remaining provisions remain in full force. 16.3 Assignment. We may assign these Terms in connection with a merger or sale of assets. 16.4 Force Majeure. We are not liable for delays or failures due to causes beyond our reasonable control.
